Terms of Service & EULA

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. If you are under the age of majority in your jurisdiction, you represent that you have your parent or legal guardian's permission to use the App.

2. Account Registration

The App uses Google OAuth to authenticate and create your account. By signing in, you authorize us to receive certain profile information from Google as described in our Privacy Policy.

• You are responsible for maintaining the confidentiality and security of your account and for all activity that occurs under it.
• You agree to provide accurate information and to promptly notify us of any unauthorized use of your account.

3. License Grant

Subject to your compliance with these Terms, QalbQuest grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use.

This license does not permit you to:

• Copy, modify, distribute, sell, lease, or create derivative works of the App;
• Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law;
• Remove, alter, or obscure any proprietary notices;
• Use the App for any unlawful purpose or in violation of these Terms;
• Use any automated system (bots, scrapers) to access the App.

4. Intellectual Property

The App, including all content, features, functionality, decks, questions, text, graphics, logos, the "QalbQuest" name and marks, and underlying software (collectively, "Our Content"), is owned by QalbQuest or our licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 3, no right, title, or interest in Our Content is transferred to you.

User Content: You retain ownership of any content you create within the App, including diary entries, reflections, and responses ("User Content"). By submitting User Content, you grant QalbQuest a limited, non-exclusive, worldwide license to host, store, and process such content solely as necessary to operate, maintain, and provide the App's features to you (and, where applicable, your linked partner). We do not use your private User Content to train AI/ML models, and we do not sell User Content to third parties.

5. Subscriptions, In-App Purchases, and Payments

5.1 Available Plans

The App may offer a free tier and one or more auto-renewable subscription plans (e.g., Monthly, Yearly) that unlock premium features such as additional decks, the shared memory diary, and relationship action tasks. Current pricing and plan details are displayed within the App prior to purchase.

5.2 Payment Processing

All payments are processed exclusively through your Apple App Store account or Google Play account, depending on the platform used to download the App. QalbQuest does not process, collect, or store your payment card information.

5.3 Auto-Renewable Subscriptions — Mandatory Disclosures

If you purchase an auto-renewable subscription, the following terms apply, consistent with Apple App Store Review Guideline 3.1.2 and Google Play billing policies:

• Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew for the same duration and at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price agreed upon at purchase.
• Managing and Cancelling: You can manage your subscription and turn off auto-renewal at any time by going to your Account Settings on the App Store or Google Play after purchase.
• Refunds: All billing inquiries and refund requests must be directed directly to Apple (reportaproblem.apple.com) or Google Play (support.google.com/googleplay).

6. Third-Party Services and Infrastructure

The App relies on third-party infrastructure and services, including Amazon Web Services (AWS), Supabase, Google OAuth, analytics providers, Apple App Store, and Google Play. Your use of the App is also subject to the applicable terms of these third parties.

7. Standard Apple EULA Terms (Apple App Store Distribution)

If you downloaded the App from the Apple App Store, the following terms apply:

• This Agreement is between you and QalbQuest only, not with Apple, and Apple is not responsible for the App.
• The license granted is limited to a non-transferable license on any Apple-branded product that you own or control.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• In the event of any failure to conform to applicable warranties, you may notify Apple for a refund of the purchase price; Apple has no other warranty obligation.
• Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. THE APP IS INTENDED TO FACILITATE PERSONAL REFLECTION AND CONVERSATION BETWEEN PARTNERS AND IS NOT A SUBSTITUTE FOR PROFESSIONAL RELATIONSHIP COUNSELING, THERAPY, LEGAL ADVICE, OR RELIGIOUS GUIDANCE.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Ontario, Canada.
